Terms and Conditions

Effective Date: January 27, 2025

These Terms and Conditions (“Agreement”) govern the use of photography services provided by Galina Cox Photography (“Photographer,” “we,” “us,” or “our”). By engaging in our services, you (“Client”) agree to abide by the terms set forth below.

1. Services

Galina Cox Photography agrees to provide photography services as outlined in the service agreement or booking confirmation. The scope of services includes but is not limited to portrait, event, and commercial photography.

2. Booking and Payment

- A non-refundable deposit is required to secure a booking. 

- The remaining balance must be paid in full before or at the day of the scheduled session or event.

- Failure to make full payment may result in cancellation of the session without a refund of the deposit.

3. Cancellations and Rescheduling

- Cancellations by the Client must be made in writing at least two days before the scheduled session.

- Rescheduling requests are subject to availability and may incur additional fees.

- If Galina Cox must cancel due to unforeseen circumstances, the Client will be offered a full refund or the option to reschedule.

4. Copyright and Usage Rights

- The Photographer retains all copyrights to images created during the session.

- The Client receives a personal, non-commercial license to use the images for personal purposes such as printing, sharing on social media, and displaying.

- Commercial use of images requires written consent from Galina Cox Photography and may incur additional licensing fees.

5. Model Release

By participating in a photography session, the Client grants Galina Cox Photography permission to use images for promotional purposes, including but not limited to website, portfolio, social media, professional competitions and marketing materials, unless otherwise agreed in writing.

6. Liability

- The Photographer will take all reasonable precautions to ensure high-quality images but is not responsible for circumstances beyond their control (e.g., weather, venue lighting conditions, or Client cooperation).

- In the event of equipment failure or data loss beyond the Photographer’s control, liability is limited to a refund of the session fee or a reshoot at no additional charge.

7. Client Conduct

Clients are expected to behave respectfully during photography sessions. Disruptive, inappropriate, or illegal behavior may result in immediate termination of the session without a refund.

8. Turnaround Time and Delivery

- Images will be edited and delivered within discussed time.

- Digital images will be provided via an online gallery or other agreed-upon means.

- Additional editing requests beyond standard retouching may incur extra fees.

9. Force Majeure

Galina Cox Photography is not liable for delays or failures in performance due to causes beyond our reasonable control, including but not limited to natural disasters, illness, or governmental restrictions.

10. Dispute Resolution

Any disputes arising from this Agreement shall be governed by the laws of the State of Utah Jurisdiction and resolved through mediation or arbitration before resorting to legal action.

11. Amendments

Galina Cox Photography reserves the right to amend these Terms and Conditions at any time. Updated terms will be posted on our website and shall take effect immediately.
